What does this policy cover?

This policy describes how Win Win Fundraising Limited of Tanfield Business Centre, Stanley, County Durham, DH9 9DB, registered company in England & Wales 13587841, (also referred to in this policy as “Win Win”, “we”, “the company” or “us”) will make use of your data when you access, (also referred to in this policy as the “website”, “site” or “platform”), participate in Win Win draws (electronically, by post, or in person at an event), subscribe to the mailing list, or contact us (electronically, by post, or in person).  We are the controllers for the personal data we collect described in this policy for the purposes of the Data Protection Act 2018 (the “Act”) and the General Data Protection Regulation 2016/679 (the “GDPR”).

This policy also describes your data protection rights, including the right to object.  More information about your rights, and how to exercise them, is set out in the “What rights do I have” section of this policy.  It also describes the use of cookies and other similar technologies when you visit or use the site in the cookies policy section below.

Privacy Policy

What information do we collect?

We collect and process personal data about you when you interact with us or the site, and when you participate in draws on the platform.  This includes your:

  • Where you set up an account or complete a transaction:
    • Name
    • Date of birth
    • Contact information, for example:
      • Postal address, email address, telephone number
    • Payment and delivery details for any purchase, including billing address and payment card details or wallet details (apple pay/google pay/PayPal etcetera), but please note that this information is handled by and processed by a third party (stripe and PayPal)
    • Social information, for example if you sign up using google or facebook we will populate your Win Win profile with information from the relevant account used when registering – any missing information must be entered into your profile manually as per the Terms and Conditions
  • Where you interact with regards to marketing communications:
    • Your marketing preferences including any consent you have given (where applicable)
    • Information related to the browser or device you use to access our platform
  • Where you voluntarily participate in any surveys or market research (on the site or social media channels operated by Win Win):
    • Survey information such as shopping habits and preferences, age, gender, income, or other information which is relevant, and you have volunteered said information to us
  • Where you win a draw:
    • Any personal data necessary to grand the prize, for example:
      • Name, address, insurance details, tax details, ownership document details etcetera
    • Photographs, video recordings, testimonials, quotes, and any other information you volunteer as part of the winning process, this information will be freely given to Win Win and can be used now and in the future for promotional purposes on our website, social media channels and print.

How do we use this information, and what is the legal basis for this use?

We detail below the purposes for which we use this information, how we use it and who we share it with, and the legal basis for that use.

Personal data may be shared with third party service providers, who will process it on behalf of Win Win for various operational purposes (such as website hosting, payment processing services, email communication services etcetera).

Personal data of winners may be shared for purposes of fulfilling the prize, including as part of a necessary background check or as part of preparing any required ownership documents.  With permission, personal data for winners may also be shared publicly on the website, social media channels and in print for the purposes of publicising who won the draws, this includes names, photographs, video footage, audio recordings, quotes, and testimonials.

More specifically we process personal data related to the website for the following purposes and legal bases:

  • To fulfil a contract or associated work to facilitate fulfilment.  Where you enter a Win Win draw, we will use your information:
    • To take payments
    • To draw winner(s)
    • To verify your identity
    • To arrange delivery or provision of prizes for the winner(s) of the draw(s)
    • To communicate with you, including sending you automated service and marketing messages
    • To provide customer service
  • As required by Win Win to conduct our business and pursue our legitimate interests, we will use your information:
    • To process payment card details, payments and check the validity of the sort code, account number and card number you submit to prevent fraud (which is processed by our third-party payment vendors)
    • To provide the prize to winners
    • To help us monitor, improve, and protect our products, content, services, and the site, both online and offline
    • To investigate and respond to any complaints received from you or from others, about the website or our products or services
    • To provide products and services you have requested
    • Where you have transacted with us, to send you direct marketing (for example, email, text message or instant messaging) in relation to our current activities, future events and draws.  You can opt out of this marketing:
      • At the time of the collection of your details
      • By using the links within the marketing communications
      • By contacting us
    • To personalise the site, our products, or services for you
    • To provide targeted advertising on the site, selected partner sites and social media channels

    • Where you have signed up to our mailing list, to send you direct marketing in relation to Win Win products and services

    • In connection with photographs, video footage, audio recordings and information about you if you win a draw and choose to provide that information for the purposes of marketing to the public
    • To use on other occasions the data for the purpose that we explain at the time we seek your consent
  • For purposes which are required by law, we may use your information:
    • In response to requests from government or law enforcement agencies conducting an investigation or the law courts

Please note that if you post a comment to the website or other social media channels, the information that you choose to post, including any personal data that you choose to post or which is available publicly, may be available to the public.

If the business is sold or merged with another business, your details will be disclosed to our advisers and any prospective purchaser’s adviser(s) and will be passed to the new owners of the business.  Any action they take from then on will no longer be our responsibility and their privacy policy would apply.

Personal data may be shared with government authorities and/or law enforcement officials if required for the purposes above, If required by law or If required for the legal protection of our legitimate interests in compliance with applicable laws.

Withdrawing consent or otherwise objecting to direct marketing

Wherever we rely on your consent, you will always be able to withdraw that consent, although we may have other legal grounds for processing your data for other purposes, such as those set our above.

What rights do I have?

You have the right to ask us for a copy of your personal data, to correct, delete or restrict processing of your personal data, and to obtain the personal data you provide to us for a contract or with your consent in a structured, machine-readable format.

How long will you retain my data?

Where we process Win Win account data, we do this for as long as you are an active user of Win Win sites and for 6 years after this.

Where we process personal data for marketing purposes or with your consent, we process the data until you ask us to stop and for a short period after this (to allow us to implement your requests).  We also keep a record of the fact that you have asked us not to send you direct marketing or to process your data indefinitely so that we can respect your request in future.

Where we process personal data in connection with processing your contest entry, we keep the data for up to 6 years from your last interaction with us.
