Terms and Conditions

The following Terms and Conditions apply to all entries to any Win Win prize draw, including both paid and free entry routes.

When registering with Win Win all registered users are required to acknowledge that they have read, understood, and accept these Terms and Conditions and agree to be bound by them without exception.  When opening the link to read the free entry method as detailed in term 6 they are required to acknowledge that they have read, understood, and accept these Terms and Conditions and agree to be bound by them without exception.

Definitions

Please note that throughout these terms and conditions, plural, singular, capitalised, non-capitalised and differing tense versions of these defined words are in use and these variations are to have the same definition as below.

  • Beneficiary A UK registered charity who will receive a donation in accordance with terms 39(d), (f), 45 and 63 in the draw where they are the nominee.
  • Closing Date The date when all online ticket sales will be suspended and from which the postal entries have two working days to reach the address in Term 6 to be counted in the draw.
  • Disqualify An entrant who held a valid entry that shall be discounted from any opportunity of winning.
  • Draw An event where a prize is awarded to an entrant.
  • Draw Database The list of entrants and their entries which is used to determine a winner.
  • Draw Date The date on which the winner will be drawn for the associated draw.
  • Entrant An individual who holds a valid entry to a draw.
  • Entry A unit counting as a single chance of being drawn as a winner.  This can be both or either a paid entry ticket via the online store or a free entry through the postal route.
  • Hand Delivery An item which has been delivered to the address in term 6 without having been through the standard post system (UK Royal Mail) and as such, features no postage marks or evidence of having been sent via the Royal Mail.
  • Membership Form The registration form used when becoming a registered user but not where a social media login has been used to register.
  • Operator The organisation responsible for organising the draw, for the purposes of this document, the operator is Win Win Fundraising Limited (13587841) of Tanfield Business Centre, Stanley, County Durham, DH9 9DB, and referred to in this document as “Win Win”, “We”, the “Company”, and the “Operator”.
  • Personal Delivery See “Hand Delivery”.
  • Platform The Win Win system of fundraising, consisting of the website, and model which allows entrants to participate in draws to win a prize, resulting in a sale to the prize partner and a donation to the beneficiary nominated in the draw for a fee.
  • Prize An item, event or some other object (material or immaterial) of value, given to the winner of the associated draw.
  • Prize Partner An organisation who have agreed to provide the prize associated with a draw in return for advertising and marketing of that draw, and who may also provide loans of the prize or examples of such.
  • Purchaser An individual who has purchased a paid ticket into a draw.
  • Registered User An individual who has used the website to register an account with the operator, this can be either through an email address or social media account.
  • Ticket See “Entry”.
  • Trustee An individual person or member of a board given control or powers of administration of property in trust with a legal obligation to administer it solely for the purposes specified.
  • Unique Draw ID Each draw has a unique identifier assigned to it and removes any ambiguity concerning similar draws.  It is clearly marked in each draw.
  • Visitor An individual who has viewed the website but has not yet registered or acknowledged these Terms and Conditions or the Privacy and Cookie Policy.
  • Void Not valid.
  • Website The online website accessed at the domain winwin.uk.com, it includes all subdomains.
  • Winner The entrant who has been drawn as the recipient of the prize in the associated draw.

The Operator

  1. All draws are operated by Win Win, and Win Win is the official sponsor of every draw unless specified otherwise.  Where the prize has been sourced from a Win Win Prize Partner, Win Win is authorised by that prize partner to offer their product(s) and/or service(s) as a prize in the draw, including any media and literature sourced from the partner.

How to Enter

  1. By submitting an entry, entrants agree to be bound by these terms and conditions.  If you do not agree to these terms and conditions, do not submit an entry to the draw, this includes the purchase of tickets or free postal entries.
  2. To validly purchase Win Win tickets and validly enter a draw, a visitor must become a registered user by completing all details on the membership form on the website, or by logging in using a social media account allowable on the website, and ensure that all details are completed in the ‘my account’ section of the website and:
    • (a) Purchase at least one ticket to one draw to make an entry into that draw before the draw has closed, or
    • (b) Submit a draw entry via the free postal entry option (see terms 6 for more details on free postal entry).
  3. Purchases of Win Win tickets shall be processed by our online third-party merchant service which is currently either Paytriot for card transactions or WooPayments for online wallet payments.  The transaction must be in Great British Pounds Sterling only (£ GBP).
  4. Purchasers of Win Win tickets will be asked to provide their contact details, including an email address and a telephone number.  This information will be processed in accordance with the provisions below and Win Win’s privacy policy.  Win Win’s relevant merchant service will require the purchaser’s postcode and card payment details.  Once the purchase order for the Win Win ticket(s) is submitted, the registered users card payment will be electronically approved, and Win Win will not have access to any records of the registered user’s card details.  The user has the option to store card details for a faster checkout experience, but this data is private to the user only, and is stored securely by our third-party hosting service or payment merchant, you have access to this information and can edit or delete, from the ‘my account’ section of the website.
  5. Entrants entering a draw via the free postal entry route do not need to become registered users but must complete all below items (a) to (l) without exception and exactly as described otherwise the entry will be voided and not count as a valid entry into a draw.
    • (a) Send a postcard through the standard post in the UK (currently Royal Mail) by first-class postage to: Win Win Fundraising Limited, Tanfield Business Centre, Stanley, County Durham, DH9 9DB.
    • (b) There is no requirement for recorded, insured or otherwise premium postage to be used, standard first-class post is sufficient.
    • (c) The postcard must:
      • (i) be handwritten and clearly legible.;
      • (ii) Be received within two working days of the draw closing date.
    • (d) On the postcard you must write:
      • (i) The title of the draw in full, including the charity or non-profit beneficiary mentioned in the title and SKU;
      • (ii) Your full name;
      • (iii) Your email address;
      • (iv) Your address;
      • (v) Your contact telephone number;
      • (vi) Your date of birth.
    • (e) One entry per postcard only.  If the postcard is contained within an envelope or other container, there shall only be one contained postcard.  If multiple postcards are included within the same container, all shall be voided and not entered into the draw;
    • (f) If insufficient postage has been paid, your entry will be voided;
    • (g) Each valid free entry will be manually populated into the draw database and assigned an equal chance of winning as a single valid paid entry;
    • (h) Each free valid entry does not count towards ticket sale quantity in the case of a draw having minimum ticket sales;
    • (i) As with all electronic paid entries, your details will be stored in line with our privacy policy.  This is true for all valid and voided postal entries.  This is facilitated by the postcard being scanned, photographed, or otherwise digitised by us and then stored securely electronically, the original will subsequently be destroyed;
    • (j) Personal and hand deliveries will not be accepted;
    • (k) You will be subscribed to our mailing list by submitting an entry via the free postal route.  You can unsubscribe from this by following the guidance within our privacy policy;
    • (l) You agree to be bound by our privacy policy and these terms and conditions without exception by submitting a free entry.
  6. Purchasers of tickets into a Win Win draw MUST be a UK resident and at least 18 years of age.
  7. Transaction fees incurred by Win Win with regards to awarding prizes and completing online merchant services which are out of the control of Win Win will be absorbed by Win Win as part of the standard terms agreed between the beneficiary and prize partner, and not passed onto the purchaser.
  8. All entrants are responsible for submitting all necessary data to Win Win without exception, failure to submit required information will void an entry or draw win.
  9. Win Win is in no way liable for any failure or inability to contact any entrant due to any errors, omissions or inaccuracies in the contact details provided by the Entrants or otherwise.
  10. Win Win will process and use your personal data to make contact under the following circumstances:
    • (a) To notify any winner that they have won a prize in a draw;
    • (b) To administer the website and conduct draws;
    • (c) To communicate with registered users and postal entry players;
    • (d) After a draw to post the winner’s name, approximate location (typically postal town or county, but never a full address), image, video footage and/or audio recordings and quotes for the purposes of media communications and promoting the current and future draws or the platform;
    • (e) More information is available in the privacy policy.
  11. Win Win accepts no responsibility or liability for:
    • (a) Entries that are lost, mislaid, damaged, or delayed in transit, regardless of cause including but not limited to:
      • (i) Equipment failure;
      • (ii) Technical malfunction;
      • (iii) System, satellite, network, server, computer hardware or software failure of any kind;
      • (iv) Acts of God;
      • (v) Adverse weather;
      • (vi) Natural disasters;
      • (vii) Terrorism;
      • (viii) Emergency;
      • (ix) Force majeure;
      • (x) Other unforeseen circumstance outside of Win Win’s reasonable control.
    • (b) Postal entries which are lost, mislaid, damaged, delayed in transit, received at an incorrect address, or otherwise voided for reasons including but not limited to:
      • (i) Industrial action;
      • (ii) Failure or delay of postal service;
      • (iii) Equipment failure;
      • (iv) Technical malfunction;
      • (v) System, satellite, network, server, computer hardware or software failure of any kind;
      • (vi) Acts of God;
      • (vii) Adverse weather;
      • (viii) Natural disasters;
      • (ix) Terrorism;
      • (x) Emergency;
      • (xi) Force majeure;
      • (xii) Other unforeseen circumstance outside of Win Win’s reasonable control.
    • (c) Any other attempted entry to a draw which is not specifically described within these terms and conditions.
  12. An entry regardless of route (electronic/free postal) shall be voided without refund or compensation if the entrant engages in:
    • (a) Any form of fraud, whether actual or apparent;
    • (b) Fraudulent misrepresentation;
    • (c) Fraudulent concealment
    • (d) Hacking or interference with the proper functioning of the website
    • (e) Amending or unauthorised use of any code that constitutes the website
    • (f) A criminal offence which contravenes the ethical standing of Win Win
    • (g) Any derogatory publication or detrimental action intended or achieved against Win Win, any associated beneficiary or prize partner or any of their officers or staff (at the discretion of Win Win)
  13. Each individual entrant can submit as many entries as they wish.  This can be exclusively paid entries, free entries, or a combination in any ratio.  Paid online entries has been limited to 20 per transaction to mitigate potential financial errors on the entrant’s part.
  14. Each ticket is non-refundable under any circumstance unless term 19(b) applies.
  15. Each ticket is non-transferrable.
  16. If a prize partner withdraws the prize, an alternative of similar market value will be sourced.
  17. If a named beneficiary withdraws their support, an alternative of equal ethical standing shall be sourced at the discretion of Win Win.
  18. If term 17 is unable to be fulfilled, then the draw may either:
    • (a) Continue with a cash alternative prize
    • (b) Be withdrawn and a full refund issued to all entrants, free postal entries shall be entered into an alternative and comparable draw without prejudice
  19. If term 18 cannot be fulfilled, the donation value shall be divided equally between previous beneficiaries at the discretion of Win Win.
  20. The ticket price is per entry and must be paid in full for each entry, a working example of this is below:
    • (a) Entrant A would like 10 (ten) chances of winning Draw X.
    • (b) An individual ticket costs £1.00 (one pounds sterling).
    • (c) Entrant A must:
      • (i) Purchase between 0 (zero) and 10 (ten) valid paid tickets
      • (ii) Post between 0 (zero) and 10 (ten) separate valid postal entries
      • (iii) Purchase and post any combination of the above in point (i) and (ii) in any combination totalling 10 (ten) valid entries.
    • (d) Entrant A decides to send 3 (three) free valid postal entries and purchases 7 (seven) valid paid tickets.  This would cost £7.00 (seven pounds sterling) plus three times the cost of first-class postage/postcard etcetera.
  21. Only valid entries will be entered into the draw with a chance of winning the prize.
  22. Voided entries will not be entered into the draw and have no chance of winning the prize.

Eligibility

  1. Draws are open for entry to private individuals only (not companies, corporations, conglomerates, enterprises, non-profit organisations, councils, societies etcetera), who are aged 18 (eighteen) years of age and over, who are permanent residents in the UK.
  2. Those private individuals who cannot enter and who will not be eligible to win the prize even if drawn as the winner are listed below:
    • (a) Employees, officers or volunteers in any capacity of:
      • (i) Win Win Fundraising Limited
      • (ii) The named beneficiary for that draw
      • (iii) The prize partner sponsoring that draw.
    • (b) Immediate family of those mentioned in term 26(a), immediate family members are listed below:
      • (i) Parents;
      • (ii) Siblings;
      • (iii) Children;
      • (iv) Stepparents;
      • (v) Stepsiblings;
      • (vi) Stepchildren;
      • (vii) Spouse or Partner.
  3. All entrants purchasing tickets to a draw confirm that they are eligible to do so and eligible to claim and prize in the relevant draw.  Win Win may require any entrant, including any winner to provide documentary evidence that they are or were eligible at the time of entry and awarding of prize.
  4. Win Win will not accept and will not refund or compensate paid entries that are:
    • (a) Automatically generated by computer, bot, or other automation method;
    • (b) Completed by a third-party;
    • (c) Paid for using a payment method owned by someone other than the entrant;
    • (d) Altered, reconstructed, forged, or tampered with;
    • (e) Incomplete.
  5. Win Win will not accept and will not refund or compensate free postal entries that are:
    • (a) Not hand-written;
    • (b) Completed by a third-party;
    • (c) Illegible, have been altered, reconstructed, forged, or tampered with;
    • (d) Incomplete;
    • (e) Incorrectly sent by post;
    • (f) Delayed in receipt at Win Win’s specified address;
    • (g) Not compliant with term 6.
  6. Win Win can, at its own discretion, disqualify without refund or compensation an entrant if their conduct (online, in person, in print or other communication) is contrary to the ethics, intention or spirit of the platform, or if the entrant violates term 13(g).
  7. Paid and free entries on behalf of another private individual, or entries which constitute a joint submission will be voided and not refunded.
  8. By registering an account online or entering a draw (paid or free), the entrant confirms that all submitted information is accurate, true, current, and complete.  Win Win reserves the right to disqualify without refund or compensation any entrant (at the discretion of Win Win) if there are reasonable grounds to believe the entrant has acted in breach of any of these terms and conditions.
  9. Win Win reserves the right to close or suspend a registered users account (and prevent the entrant from creating another account or participating in any other or future draw) at any time and for any reason.  Without limiting the previous statement in term 33, Win Win is entitled to close or suspend a registered users account if:
    • (a) Win Win considers that the registered user is entering draws in an excessive manner;
    • (b) The registered user has become bankrupt;
    • (c) Win Win considers that the registered user has used the website in a fraudulent manner or for illegal and/or unlawful or improper business;
    • (d) Win Win considers that the registered user has used the website in an unfair manner, has deliberately cheated or taken unfair advantage of Win Win or any of its other registered users or if the registered users account is being used for the benefit of a third party;
    • (e) Win Win is requested to do so by the police, any regulatory authority recognised by the UK Government or law court;
    • (f) Win Win considers that any of the events referred to in terms 33(a), (b), (c), (d) or (e) may have occurred or are likely to occur;
    • (g) The registered user account is deemed to be dormant.
  10. If Win Win closes or suspends the registered users account for any of the reasons referred to in term 33 in its entirety, the registered user shall be liable for all claims, losses, liabilities, damages, costs, and expenses incurred or suffered by Win Win, beneficiary or prize partner arising therefrom and shall indemnify and hold Win Win, beneficiary and prize partner harmless on demand for the same.  In the circumstances referred to in term 33, Win Win will disqualify the entrant from any active draw, will not refund or compensate any tickets purchased and the entrant will forfeit any prize they may have won but are not yet in legal possession of.
  11. If an entrant wins a prize but does not meet the eligibility criteria or contravenes any term within these terms and conditions, they automatically forfeit any prize and are disqualified from all active draws without refund or compensation, and term 43(b) takes effect.

Prizes and the Draw

  1. The winner for each draw will be determined and awarded the prize listed within the draw which they entered.
  2. The draw to determine the winner(s) will be made on the draw date wherever possible.  If an unforeseen issue prevents the draw taking place on the scheduled draw date it will be postponed for the minimum required time, and the new draw date shall be communicated to all entrants via email.
  3. Where a guaranteed draw date is stated, Win Win will never extend this date to facilitate further ticket sales.  Sales will be suspended on draw date regardless of date of actual draw.
  4. Unless otherwise stated, there is no minimum paid ticket sales required for each draw, but the below applies:
    • (a) The paid ticket sales must exceed the purchase value of the prize for it to be awarded;
    • (b) Paid ticket sales must exceed the cash alternative value listed, where applicable;
    • (c) If term 39(a) is not satisfied, the listed prize will not be awarded;
    • (d) If term 39(a) is not satisfied, then the total value of the ticket sales shall be divided into 50%, 20%, 10% and 20% with the draw winner receiving 50% of the total value of paid ticket sales as a cash prize, the named beneficiary receives 20%, the prize partner receives 10% and Win Win receives 20%;
    • (e) If term 39(b) is not satisfied, the listed cash alternative prize will not be awarded;
    • (f) If term 39(b) is not satisfied, then the total value of the ticket sales shall be divided into 50%, 20%, 10% and 20% with the draw winner receiving 50% of the total value of paid ticket sales as a cash prize, the named beneficiary receives 20%, the prize partner receives 10% and Win Win receives 20%.
    • (g) Should there be no prize partner involved in a draw, the designated 10% due to the prize partner stipulated within 39(d) and 39(f) shall be equally divided between the named beneficiary and Win Win.
  1. Win Win will contact you should you win a draw to confirm your bank details so the value can be transferred directly into your bank account in the event of a cash prize alternative being awarded due to either:
    • (a) Term 39(a) not being satisfied and term 39(b) being satisfied;
    • (b) The entrant accepts the listed cash alternative as opposed to the prize, where applicable.  This will be specifically noted on the listing if available and is non-negotiable.;
    • (c) Term 19(a) is required to be implemented.
  2. Should a cash alternative be awarded in line with term 40 your bank details shall be deleted or otherwise destroyed upon transfer of prize funds.
  3. On a draw draw date, which is the date on which the draw takes place, not the date the paid entry route closes:
    • (a) There will be a draw to determine the winner;
    • (b) The winner shall be contacted to award the prize.
  4. If any winner cannot be contacted by Win Win including Win Win receiving a satisfactory and not automated response within 30 calendar days by telephone or email and with only the details listed on the registered users account or postal entry:
    • (a) The winner forfeits the prize without refund and without compensation;
    • (b) A second draw will be held, and another winner shall be selected. 
  5. Should the second winner not be contactable in the same way as the first in accordance with term 43, then terms 43(a) and 43(b) apply, and a third draw shall take place and a third winner selected.
  6. Should a third winner not be contactable in the same way as the first and second winners as in terms 43 and 44, then terms 43(a) and 43(b) apply, and the draw shall be terminated, with the total value of ticket sales being divided into 50%, 20% and 30% with 50% being donated to the named beneficiary, 20% being donated to the prize partner and 30% being retained by Win Win.  Should there be no prize partner involved in a draw, the designated 20% stipulated within clause 45 due to the prize partner shall be equally divided between the named beneficiary and Win Win.
  7. On a draw close date:
    • (a) No further paid ticket sales shall be allowed on that draw;
    • (b) Free entries shall be manually entered into the draw database for all free entries received during the dates the draw was accepting paid tickets and up to two working days after the close date (to allow for first class entries submitted to the postal system on the final date of ticket purchases being valid).
  8. Win Win will endeavour to ensure each draw is carried out using as close to a true random number generator as possible.  At the moment this is the random number generator hosted at random.org operated by Randomness and Integrity Services Limited (489434), a random number generator which allows us to assign a range of values between -1,000,000,000 (negative one billion) and 1,000,000,000 (one billion), allowing the number of tickets in each draw to be 2,000,000,001 (two billion and one).  It also uses an atmospheric noise system to generate a truly random number compared to a pseudo-random number assigned by a mathematical algorithm.  The system was built and developed by Dr. Mads Haahr of the School of Computer Science and Statistics at Trinity College, Dublin.  This is the method we have selected as it is the most impartial, truly random, and least susceptible to corruption we could source.
  9. Should we be unable to use random.org as specified in term 47, best efforts shall be afforded to source another random number generator to complete the draw.
  10. Each ticket regardless of entry route, paid or free, shall be assigned a unique number in the database, and it is this number which the random number generator referenced in terms 47 and 48 shall draw.  Alongside each unique number and ticket is the name of the entrant along with a unique ID linked to the entrants account, which means that two entrants with the same name cannot be confused between each other in the draw.
  11. The results of the draw are final, and Win Win shall not enter into any correspondence in relation to the same except for when the request originates from:
    • (a) The police;
    • (b) The law courts;
    • (c) Relevant government agency.
  12. Each draw shall be recorded electronically and stored securely so if a dispute arises and a request if issued for proof of the draw originating from either:
    • (a) The police;
    • (b) The law courts;
    • (c) Relevant government agency.
  13. As the recording will contain personal information of all entrants, it will never be released at the request of anyone other than those mentioned in terms 50 and 51.  Once released, all privacy and protection offered by the privacy policy of Win Win is forfeited and Win Win cannot be held liable for a data breach resulting from mishandling by the third party referenced in terms 50 and 51.
  14. For the same reason as in clause 52, there shall be no live draws published by Win Win where personal information would be displayed or communicated, except for that information referenced in term 11(d).
  15. Upon the request of Win Win, the winner will be required to forward personal identification, such as a driver’s license or passport to the promotor to prove their identity and address, and to confirm that their entry (paid or free) was made in accordance with these Terms and Conditions, and that there is no lawful impediment (pursuant to any applicable UK law) to the winner being awarded any prize in the relevant draw.  Win Win may refuse to award the prize without refund or compensation to the winner if the identification documents:
    • (a) Are not received;
    • (b) Are refused to be sent;
    • (c) Prove contravention to these terms and conditions;
    • (d) Give reason to believe there is a legal impediment to the awarding of the prize.
  16. If term 54(a), (b), (c) or (d) are satisfied, then the prize shall be forfeited by the winner without refund or compensation and a second winner shall be selected in accordance with term 44.
  17. If the winner does not live on the Great British mainland, and the prize is a physical, material object or requires in-person action, they must cover the cost of travel to Win Wins office at Tanfield Business Centre, Stanley, County Durham, DH9 9DB, from where a Win Win representative will arrange and cover the costs of further travel if necessary at the discretion of Win Win.
  18. If the winner cannot satisfy term 56, they will forfeit the prize and another draw will take place in accordance with term 44.
  19. Win Win is entitled to refuse delivery of a prize to a P.O. box or any other location that may be used to conceal the identity of a winner, to ensure that a prize is not delivered to a fraudulent individual.
  20. In cases where the prize is an experience, the winner shall be awarded a voucher and they become completely responsible for arranging between themselves and the event organiser for transport to/from the event, dates and times, and any other applicable arrangement outside the control of Win Win.  Examples of these experiences include but are not limited to:
    • (a) Track Days;
    • (b) Supercar experiences;
    • (c) Day trips;
    • (d) Holidays (Domestic and International);
    • (e) Excursions;
    • (f) Festivals;
    • (g) Concerts;
    • (h) One-off events.
  21. Win Win does not in any way guarantee or provide any warranty as to the value, condition, lifetime, history, or any other characteristic of the prize.
  22. Win Win reserves the right to remove a draw from the website at any time for any reason, and if this occurs, a full refund will be issued to every entrant using the paid route.  For those entrants who entered via the postal route, your details shall be entered into another similar draw at the discretion of Win Win.
  23. The winner has the right to forfeit the prize if they wish for whatever reason, in this instance the value of the ticket sales shall be distributed in accordance with term 45.

Beneficiary

  1. In a completed draw, the nominated beneficiary for each associated draw shall receive the indicated percentage of all net profit generated from each draw.  Net profit is the monetary value remaining from all ticket sales, minus expenses, which includes the cost of the prize, any associated advertising and running costs, any applicable taxes or fees relating to that draw.  Expenses do not include the wages of anyone at either the beneficiary, the promotor or prize partners organisations.
  2. Where a draw cannot be completed due to terms 39, 45 or 55 then the charity will receive the percentage specified within term 39(f) where term 39 is the reason the draw was not successfully completed, and the percentage specified within term 45 where terms 45 or 55 are the reason the draw was not successfully completed.
  3. If term 18 is satisfied, then term 20 shall be executed in accordance with terms 62 or 63 as applicable.
  4. The nominated beneficiary shall receive the monetary value as a donation from Win Win Fundraising Limited by way of a cheque or bank transfer.

Announcement of Winner(s)

  1. Win Win reserves the right to announce and publish any of the information outlined in the privacy policy and term 11(d) pertaining to any draw’s winner on the website, in email marketing, social media outlets, print, online and in any other communicative methods available which may be visible to the public or worldwide.
  2. Should the winner refuse or impede term 66 in any way, Win Win reserves the right to withhold or retake ownership of the prize, or recover the full costs of the prize from the winner.

Limitation of Liability

  1. As is permitted by law, Win Win, the beneficiary and the prize partners’ employees, officers, staff or volunteers, will not in any circumstances be responsible or liable to compensate any entrant or associate of any entrant or accept any liability for any loss, damage, personal injury or death occurring as a result of submitting an entry or postal entry, or in relation to the use and/or enjoyment of a prize by the winner gained through any draw, except where death or personal injury is caused by the negligence or fraud of Win Win, beneficiary or prize partners employees, officers, staff or volunteers.
  2. The limit of liability of Win Win to each entrant is limited to the aggregate value of the entry fees paid by that entrant.
  3. Win Win accepts no liability for errors or omissions contained within the description of any prize awarded as part of any of the draws on the website, or the prize value, or any other description or specification or any other part of the website.  It is the responsibility of the entrants to satisfy themselves as to the accuracy of any such details and/or content of the website.
  4. Win Win accepts no liability for errors or omissions caused by human error or technical faults within Win Win’s technological infrastructure.
  5. Win Win accepts no liability for non-receipt or issues with receipt of a prize due to errors in information provided by the winner, such as incorrect bank account details or a wrong delivery address.
  6. Should the wrong bank details have been submitted, the winner is fully responsible for the recovery of funds and/or forfeits it.
  7. Should the wrong delivery address have been submitted, the winner is fully responsible for the recovery of the prize and/or forfeits it.

General

  1. Win Win shall not be a trustee of any entry fees received unless it is subject to a specific contractual agreement with a beneficiary or prize partner to act as such.
  2. Win Win reserves the right to suspend or cancel any draw at any time, either before or after entries and/or postal entries have been received.  If a draw is cancelled due to Win Win’s actions and specifically not those of the prize partner, beneficiary or any other party associated with that draw, Win Win will refund and/or reassign entries in accordance with term 61.
  3. Where term 61 has been executed, Win Win shall have no further liability to those entrants.
  4. Without prejudice to the operation of term 77 Win Win reserves the right to cancel any draw in the event that an order is made or a resolution is passed for the winding up of Win Win, or an order is made for the appointment of an administrator to manage the affairs of Win Win, or circumstances arise which entitle a court or creditor to appoint a receiver or manager or which entitle a court to make a winding up order, or Win Win takes or suffers any analogous action in consequence of debt or an application to court for protection from its creditors is made by Win Win.
  5. Win Win reserves the right to make reasonable amendments to these terms and conditions at any time, with immediate effect upon publishing such amendments on the website.  Any such amendments shall not prejudice any entries or postal entries received prior to the time of such changes.
  6. These terms and conditions shall not create or be construed as creating any form of contract, joint venture or other agreement between any entrant and Win Win.
  7. All draws that Win Win promotes, their administration and all associated activities shall be governed by the laws of England and Wales, and all parties submit to the exclusive jurisdiction of the courts of England and Wales.
  8. If there is no prize partner, or the prize partner forfeits their share of the ticket sales as stipulated in terms 39(d), (f) and 45, their share shall be divided equally between the nominated beneficiary and the operator.
  9. If the prize partner chooses to donate the prize to the platform rather than sell it, all ticket sales less expenses as described in term 63 shall be divided between the beneficiary and operator in the same proportion as defined in term 63, which is clearly indicated on the draw, with the remaining percentage being retained by the operator.
  10. If the prize partner chooses to donate the prize to the nominated beneficiary for use in a draw, all ticket sales less expenses as described in term 63 shall be divided between the beneficiary and operator in the same proportion as defined in term 63, which is clearly indicated on the draw, with the remaining percentage being retained by the operator.

Transparency

  1. Win Win has built this platform with complete transparency as a fundamental principal of its core operating ethics and the primary objective of the platform is to raise as much capital for as many local and national charities and non-profit organisations for the good of the community and UK in its entirety.
  2. The secondary benefit of the platform is that the beneficiaries reach a larger audience, prize partners organically increase their sales and target audience, and Win Win becomes a profitable organisation.  This all leads to increased jobs on the market and an improvement in the economy of Britain.
  3. A tertiary but direct benefit of the platform is that every entrant understands that each ticket bought by them, has a direct and positive impact on the nominated beneficiary, and gives the entrant a chance to be the lucky winner whose life may be changed through the prize they have won.
  4. All accounts will be made public on companies house each year as required by UK law, which will demonstrate without question the platforms ethics and financial standing.
  5. We encourage everyone to challenge potentially unscrupulous or corrupt behaviour or language, not just on the Win Win platform, but worldwide.  We will happily disprove any accusation of unfair or unethical practice we may be accused of, as this strengthens our position as a positive influence in fundraising.
